Criminal Voir Dire

Description:

This session will cover the following:

1. Avoid prospective jurors likely to negatively influence the other prospective jurors

a. Supervisors, management level individuals, owners of companies
b. Law enforcement, security guards, military, prosecutors, judges

2. Educate the prospective jurors on your theory of the case

a. Self-defense.
b. Mistake of fact.
c. Capacity to form the intent to pre-meditate

3. Try to mention some positive factors about your client even if you don’t anticipate putting him or her on the stand to testify

a. Military veteran
b. No prior criminal record

4. Make sure to cover basic areas of criminal law

a. Presumption of innocence
b. Indictment is a charging instrument and no indication of guilt
c. First and only opportunity for my client to challenge the State’s case, cross- examine witnesses and require State to establish guilty beyond reasonable doubt
d. Reasonable doubt

5. Use the juror’s answers to your benefit by educating other prospective jurors.

a. Anyone ever have a migraine headache – DUI case where that is the defense.
b. Anyone mistakenly identify a person they knew well for stranger where identity of defendant or perpetrator is key issue.
c. Anyone been wrongfully accused of a crime or had a friend or family member wrongfully accused of a crime.
