Termination of Parental Rights: Effects of In re Carrington

Earlier this year, the Tennessee Supreme Court issued an opinion that parents facing the termination of their parental rights are entitled to representation; however, they are not entitled to effective representation. Two attorneys who worked on this case in both the Tennessee and US Supreme Court will discuss the effects of In re Carrington and what it means for both parents and attorneys in termination law.

I didn't realize that effective assistance of counsel is not a uniform standard for all trials, particularly TPRs. I also find it interesting that "failure to change circumstances" is a particular issue that must be resolved in all pre-TRP cases prior to a judge ruling in the TPR.

As a DCS attorney is was very interesting to hear what the Attorneys who represented the mother in Carrington had to say.

Only comment is that they didn’t really state the holding in Carrington until half way in. I realize that you should have read Carrington prior to watching but since it was so focal to the presentation and is a change in the law, I would have liked it discussed first then the presentation.
