Criminal Law, Appellate Practice

Winning the Appeal at the Trial Level

Description:

The Tennessee Court of Criminal Appeals is unfamiliar territory for most lawyers. Opportunities to practice in the court are few and success requires skills of oral and written advocacy. A persuasive performance in both areas is important to success; a poor performance in either can lead to defeat. In this presentation Attorney David Raybin will discuss practice tips to help you perfect your appeal before the trial ends. Some tips discussed include: reading appellate opinions, keep an Appeal file, determine issues to be appealed, and post-trial motion practice.

The Devil is in the details.

This was presented more from a practical standpoint which was most refreshing!

This program was exactly what I was hoping it would be. It had so much information, I wish there was a transcript in addition to the 34 pages of materials and 49 power point slides. I hope I can watch it several more times.

Conducting trial with a mind towards appeal, especially avoiding waiver and adequately preserving objections and obtaining a final decision on record. Always be abreast of potential changes in the law to preserve points in case the law changes. The importance of structuring briefs to clearly present the case, and of framing issues and standards of review in favor of one's case.

Great practical information!

Great insight on how to properly raise, preserve and present issues on appeal. I will have my Appeal File at trial from now on.
