In order to increase the likelihood of recovery, attorneys who are involved in construction litigation have turned to claims of negligence. Many courts including the courts of Tennessee allow recovery on claims for a party's negligent conduct on a construction project, even where no privity of contract exists. Attorney Beth Stengel will discuss Advantages of the Negligence Claim, Erosion Privity Requirement, Relationship of Tort Duty to Contractual Obligations, Persons to Whom the Duty is Owed, and Theories of Tort Liability.
