In this session the speakers will discuss enforceability of ADR Provisions. First is a discussion on Mediation. Topics include: Why Mediate, Types of Mediation, Mediation Clause Drafting, and Judicial approach to mandatory mediation clauses. Next the panel will talk about Arbitration. Why Arbitrate, Arbitration Clause Drafting, Arbitration Administrators, and Non-party Discovery.

Excellent overview and insight

I learned that third party discovery in an arbitration can raise a number of difficult issues and selecting the appropriate arbitration forum and rules is important in drafting arbitration agreements.
