Health Law: Introduction to Fraud and Abuse Laws

This panel will provide an overview of fraud and abuse laws and how they apply to federal healthcare programs. The False Claims Act, Anti-Kickback Statute, Stark, and other key regulations will be discussed. The program will also outline healthcare fraud enforcement and the applicable agency authority. For newer health law practitioners, this program provides a general health law overview and discussion of hot topics by experienced healthcare leaders.

The materials were very helpful and helped to clarify the relationship between AKS and Stark. The updated case law was also very helpful, as well, as the discussion on recent cases.

I work in TennCare so this was particularly interesting to me, outside my scope of practice but showing issues on the other side of the coin, so to speak.

I attended this introductory course in a subject area I currently practice. It was helpful to hear the presentation covering situations I work in daily, and I did hear a few insights from the governmental attorney about his perspective on health care false claims and other similar matters. While I was familiar with most of the materials from my practice, I thought this was a well-done introduction to health care fraud and abuse laws, and still valuable for a more experienced practitioner to attend as a refresher.

Outstanding, well presented, great materials.

Interesting to hear about the interplay between MD judgment and finding of falsity to support a fraud claim, since I primarily represent MDs in malpractice litigation.
