This case law update will provide an overview of some of the Tennessee cases that lawyers should consider when drafting construction contracts or providing advice to construction clients in this fast moving industry. Included cases discuss topics such as retainage, Prompt Pay Act, attorneys' fees, "course of dealing" waivers, contractor individual liability, private right of action against insurance, and bankruptcy dischargeability amongst others.
