The Coaching Conundrum: The Ethics of Witness Preparation

Description:

The ethical gaffes that lawyers make when coaching witnesses run the gamut—it’s everything from accidentally giving a prohibited “signal” to a witness, to purposefully trying to get witnesses to lie. In this program, the CLE Performer, Stuart Teicher, talks about the types of behavior that makes coaching a crisis, but also those tactics where coaching is cool. Topics include:

- Sneaky situations and Rule 8.4

- Disturbing decorum and Rule 3.5

- Permissible prodding — things you can say, that don’t violate the rules
