Construction Law 2022: 3.75 General, 1 Dual

Unique Aspects of the Mechanics’ and Materialmen’s Lien Law with Construction Case Law Update
Description:

The courses in the this package will take a look at the unique aspects of the mechanics' and materialmen's lien law. They explore special situations, such as: when are liens on leaseholds proper; is it a lien or bond claim against a hybrid project (where the property is owned by a pseudo governmental entity); who qualifies as an "owner" for purposes of serving notices of nonpayment and notices of lien; what exactly is "visible commencement of operations" and "completion of the improvement?" There will also be an ethical discussion on matters like: can an attorney "bluff" by serving a notice of nonpayment and/or notice of lien, when certain prerequisites have not been satisfied?
