Faculty Profile: Kim Looney

Kim Harvey Looney is a member of the firm at Epstein Becker Green in Nashville. Ms. Looney counsels for-profit and nonprofit health care providers, academic medical centers, physician practices, post-acute providers, ambulatory surgery centers and integrated delivery systems on federal physician self-referral and anti-kickback matters, government investigations, and the operational and compliance issues in between. Her regulatory practice focuses on the Stark Law, the federal Anti-Kickback Statute, the Civil Monetary Penalties Law and the False Claims Act. She advises clients on compliance program development, reimbursement audits, Medicare certification and reimbursement, provider enrollment and credentialing, and CMS and OIG self-disclosures. She also assists with licensing, state regulatory filings, medical staff issues, and certificate of need (CON) applications and hearings. On the transactional side, Ms. Looney advises on the regulatory aspects of mergers, acquisitions and joint ventures involving health care providers, and she has negotiated managed care agreements, professional services agreements, and physician recruitment and employment contracts. She has worked exclusively in health care throughout her career, including as a health care consultant before attending law school. She is a frequent author and speaker at national and state health law conferences, and she served on the Board of Directors of the American Health Law Association. She is currently recognized in The Best Lawyers in America (Health Care Law), Chambers USA (Tennessee, Healthcare: Regulatory) and Mid-South Super Lawyers (Health Care). She was also recognized in the Nashville Business Journal’s Best of the Bar.
