Mr. Whalen has been an associate solicitor general in the Office of the Solicitor General of the Tennessee Attorney General's Office since 2004, where he helps oversee and coordinate the State's appellate work. He served as an assistant attorney general in that Office's Criminal Justice Division between 1999 and 2004. He is originally from Massachusetts, where he served in both the Massachusetts Attorney General's Office and the Middlesex County District Attorney's Office after graduating from Boston University School of Law. Mr. Whalen has substantial experience arguing before the Supreme Court of Tennessee and the United States Court of Appeals for the Sixth Circuit. He has argued three en banc cases before the Sixth Circuit, and he argued before the Supreme Court of the United States during the Court's 2014 Term.
