Captive insurance allows companies to fund their own insurance coverage in a more cost effective manner. Captives have number of unique advantages such as risk management controls, flexible ownership structures, control over claims and litigation handling, and tax advantages. Captives are also complex, highly regulated business structures that should be set up carefully — with full understanding of the risks and drawbacks. This session will provide you with a basic understanding of this growing industry and help you advise your clients.
With the passage of the act and the efforts of the Captive Insurance Section of the Tennessee Department of Commerce & Insurance, and with the support of the Tennessee Captive Insurance Association, Tennessee is one of the fastest growing captive domiciles in the country. The growth of the captive industry in Tennessee is an exciting development for Tennessee businesses and will present new opportunities for professionals who service these companies and the businesses that form them.
This presentation will give attorneys who advise corporate clients a basic understanding of what captive insurance is, the types of captive insurance companies that can be formed, the questions any prospective captive owner should consider before forming a captive, the formation process, and managing client expectations.
