Rights of Property Owners: Recent Tennessee Supreme Court Opinion

Description:

In one of Justice Wade's final opinions, the High Court provides a "flood valve"from the lingering harsh consequences of the "gap years"(1914 to 1919) and saves a family farm.

On July 31, 2015, the Tennessee Supreme Court entered a decision which will bolster the rights of property owners against the stale claims of distant relatives arising from the early 20th century conundrum of the emancipation of women by the "Bejach statutes" and the often inequitable unintended consequence of the temporary abolition of the estates in land by the entirety. Watch your presenter sit in an empty room and talk to a camera while you learn more about the laws of adverse possession and prescription and how to defeat “luck of birth” and other stale property claims, and review the recent court opinion regarding the Bailey Farm in Loudon County (and learn a little civil procedure too)!

Knoxville attorney Mathew Grossman has focused his practice on land title litigation for most of his career and has litigated these cases in courts throughout Tennessee.
