Competency in the practice of franchise law requires legal knowledge and experience with the business issues related to franchising. Practicing franchise law, or any area of the law, without first making the investment in time and effort to become competent carries the obvious risks of malpractice claims or disciplinary action. This presentation includes discussion on performing pre-sale review of the FDD and determining whether it is in compliance. Other practice tips include a detailed discussion on due diligence, negotiation of the franchise agreement and corporate formation. Lease negotiations will also be addressed.
