Dispute Resolution 2021: Managing Arbitrator and Mediator Bias - Learning to Know What You Don’t Know

Description:

Most assume that bias is intentional and that we are aware of its influence on our behavior and intentions. However, the reality is very different. Implicit (unconscious) bias motivates arbitrators and mediators far more than explicit (conscious) bias. This session will explore how to discover and manage bias in the room when mediators and arbitrators may not be aware of its influence.
