Tax Law, International Law, & Immigration Law: Public Charge Ground of Inadmissibility & Income Tax Returns

Tax Practitioners Now Must Be Aware of How Advising Incorrectly on Taxes Could Cause their Clients to be Removed from the U.S.
Description:

Federal immigration officers have long reviewed green card applicants to ascertain whether they have the financial means to support themselves, among other considerations, to obtain permanent residency. As of September 18, 2026, immigration officers now evaluate green card applicants on whether they are likely to depend on means-tested public benefits, and this will have a direct legal connection with tax return filings and refundable tax credits. This one-hour webcast will discuss how tax practitioners will now have to be aware of how to navigate the defining & allocating of income, credits, and elections with their effect on a foreign national’s immigration status. Mismatches between reported income on IRS tax transcripts and financial data along with low adjusted gross income can now have immediate disastrous outcomes for foreign nationals, their family members, and their businesses.
