This CLE will discuss recent developments in both the case law and any statutory changes impacting litigation surrounding the Health Care Liability Act. Topics may include the cap on non-economic damages, limitations on the Lewis v. Brooks instruction, the end of the “Abshure Defense” for failing to identify agents on pre-suit notices, Notice of Intent to Sue letters and HIPAA forms, the safe harbor provision, comparative fault issues and the interplay of T.C.A. 20-1-119, as well as claims against governmental entities.
