  This session will explain the basic structure of the U.S. Health Care system providing an overview of how services are provided to individuals, how individuals obtain and maintain health care coverage, and the mechanisms and regulations surrounding how such services are reimbursed. This session will also provide an overview of the Affordable Care Act and other applicable laws that affect health care coverage and services.

  Identifying relationships subject to fraud and abuse laws is an essential skill for transactional and regulatory attorneys because every health care company and provider engages in activities regulated by such laws. We will provide a high-level overview of some of the federal laws including the Stark Law, the Anti-Kickback Statute, the False Claims Act, the Civil Monetary Penalty Provisions and the Eliminating Kickbacks in Recovery Act of 2018 and will explore the most recent updates and hot topics in enforcement activity.

  Health care providers in Tennessee routinely face investigations and disciplinary actions by their licensing bodies within the Department of Health, in addition to investigations and actions by other “licensing” bodies, e.g., Boards, the DEA, federal insurance programs, state insurance programs, private insurance programs, and credentialing health care institutions. This session will focus on the administrative process that health care providers must navigate when the Department of Health launches an investigation or pursues a disciplinary action on the provider’s license, and the implications that those actions might have.
