This panel will discuss the most significant decisions affecting entertainment law over the past twelve months. Among those decisions are Thaler v. Perlmutter, one of the first reported decisions involving artificial intelligence, and Andy Warhol Foundation for the Visual Arts v. Goldsmith, the decision from the Supreme Court of the United States clarifying the interpretation of “transformative” with respect to the fair-use defense under The Copyright Act of 1976.

In April 2023, the recording artist now known by the name “Ghostwriter” became a viral sensation after posting his original song “Heart On My Sleeve” on TikTok - a post that was viewed over 8.5 million times in just days. The song, though written by Ghostwriter, utilized artificial intelligence to mimic the voices of renowned recording artists Drake and the Weeknd, and did so shockingly well. The song sparked immediate conversation about the tremendous possibilities (and frightening consequences) presented by the use of AI in the music industry. This discussion will highlight the legal and moral issues associated with use of AI in the music industry, how states like Tennessee are working to combat those issues, and how creators are currently utilizing the technology in their work.
In this brief overview of the newly-enacted Tennessee ELVIS Act, Patrick Sabatini of Warner Music will cover what the existing TN right of publicity statute covered and then highlight the ways in which the language of the ELVIS Act modernized the existing statute and helped protect name, image, likeness, and voice rights against the potential ravages of unauthorized artificial intelligence generated deep fakes and the like.
