  • Administrative process
  • Pre-mediation submissions (contents, confidentiality, length)
  • Pre-mediation discussions or conferencing
  • Client expectations (and how to manage them)
  • Mediation attendees (need for perceived balance of power, authority to bind, attendance by telephone)
  • Mediation process and structure (need or value in opening statements and initial joint session, time limitations)
  • Settlement structure (need for specific financial or payment terms, confidentiality, indemnities, structure for new or different relationships)
  • Safety and security

Good presentation; knowledgeable presenter.

This CLE offers great tools and tips for preparing clients for mediations and good tips on how to utilize time wisely during mediation and how to keep expectations realistic throughout the whole process. With mediation being relied on much heavier these days in all types of cases, this quick review and preparation process helps prepare statements ahead of time and helps set up the mediation for a better chance of success before it even starts.

This was a mediation 101 course. It is better suited for the new attorney.

Great to be reminded of the mediation process from the litigants perspective and to be reminded that they haven't done this before and we need to fully explain the process.
