Great points about social media usage and discovery. The discussion of hearsay reminded me of a simple test that I learned years ago to test the truth of a matter asserted: "Does it matter whether the statement is true?"

It was a good course which provided a lot to think about in terms of text messages as well as strategies on a variety of other evidentiary issues. I thought it was helpful to have an attorney from both side of the aisle.

Excellent insights on when experts can use hearsay, as well as surprise utterance exceptions. I also appreciated learning more about the parameters for use of social media to either impeach or validate.

Once again, the presenters for this CLE did a nice job of bringing an interesting Plaintiff / Defendant view on issues - here different trial evidentiary issues

Excellent analysis of Rules of Evidence relating to Rule 803, 106 and 703. Really enjoyed the motions in limine discussion pertaining to motion to prevent testimony at trial regarding new memories.

Great reminder/tips about objecting to evidence offered out of context.
