Entertainment & Sports Law Forum 2024: Tennessee's Cutting Edge Rights of Publicity Statute: The Ensuring Likeness, Voice, and Image Security ("ELVIS") Act of 2024

Description:

In this brief overview of the newly-enacted Tennessee ELVIS Act, Patrick Sabatini of Warner Music will cover what the existing TN right of publicity statute covered and then highlight the ways in which the language of the ELVIS Act modernized the existing statute and helped protect name, image, likeness, and voice rights against the potential ravages of unauthorized artificial intelligence generated deep fakes and the like.

The ELVIS Act is not something I was aware of prior to this presentation. It is easy to see why it is necessary in today's AI-capable world. Hopefully there will be a way to continue legislation along these lines without infringing on the First Amendment.
