Serial Killers, CEOs, and Secrets: The Infamous People Who Shaped Confidentiality

Confidentiality is one of the most fundamental duties a lawyer owes a client, and the origins of the current rule is kind of interesting. Many of today's confidentiality standards trace back to the actions of some genuinely infamous people, including a serial killer from the 1970s, Bernie Madoff, and the Enron leadership. Stuart will discuss the scope and limits of the duty of confidentiality, when (and whether) a lawyer can ever reveal a client's secrets, entities and confidentiality, and more!

It's Alive! What Classic Movie Monsters Teach About Attorney Ethics

Dracula never dies (even when he’s killed) and Frankenstein's creature was an accidental disaster. Professional legal educator Stuart  turns classic movie monsters into ethics lessons. Stuart will discuss the notion that Dracula lives forever, and so does the lawyer's duty of confidentiality in Rule 1.6 and 1.9(c)(2), that Frankenstein was a monster because his creator’s assistant messed up. It illustrates how lawyers need to supervise (Rule 5.3), and when explorers found the Mummy, the assistant didn’t listen and the fiasco started (the parallel is Rule 5.2, duty of subordinate lawyers).
